Toxic Torts
If you or a loved one has been injured by exposure to dangerous chemicals, you may have grounds for a toxic tort. This is a type of lawsuit filed against companies that are responsible for making and distributing chemicals that injure people. They can be pharmaceutical, occupational, home, or environmental, depending on who is liable for your injuries.
If your job requires you to work with chemicals that have injured you, you might be entitled to file a lawsuit of occupational tort. This would not be filed against your employer, since you generally forfeit your right to sue them when you file for worker’s compensation. Instead, a tort can be filed against the manufacturers of the substance that injured you. If you were on a third party’s property when you were injured, the claim may be filed against them.
If you have been hurt by a faulty medication, you may file a pharmaceutical toxic tort. This is not filed against your doctor, who prescribed the drug in good faith, but against the company that produced a dangerous drug. This type of case is usually filed by many different plaintiffs at once, because drugs are sometimes widely distributed before their dangerous side effects become clear.
A home tort is called for when you are injured by unhealthy chemicals within your home. These can include dangerous building materials such as asbestos, pesticides sprayed near your home by a third party, or hazardous mold that you were not informed of when you bought or rented the property.
Environmental tort is a new type of lawsuit. It is filed against corporations that cause injury by polluting the air or a community’s water supply.
