Hours of Service Requirements
The Federal Motor Carrier Safety Administration has clear safety guidelines that all truck driver employers are required to follow. Because driver fatigue is a major contributing factor in many accidents, these guidelines require rules about how long a driver may work without a break.
These guidelines state that a driver may not operate a truck:
- With less than 10 consecutive hours of off-duty or sleeper berth time
- Longer than 11 hours following his or her break
- After the 14 hour following his or her last 10 hour break
While driving through unsafe conditions, drivers may be granted an additional 2 hours to complete his or her trip or reach a safe place to stop.
Hours of Service Violations
Drivers who are forced to violate the regulations outlined above may fall asleep at the wheel or resort to using stimulants to stay awake. Both of these options are very dangerous to everyone on the road. If your employer has ignored these important regulations, a Chicago hours of service violations attorney can help you determine whether you have a case.
