Professionals are held to higher standards in their fields of expertise. Unlike laypeople, who may only be judged based on a standard of reasonable conduct, professionals are even more responsible for the work they do.
While the word malpractice is most often associated with doctors, nurses, and other medical personnel, it actually applies to a much broader spectrum of professional workers. Lawyers who misrepresent or bungle their clients’ cases, an accountant whose errors destroy their clients’ finances, or an architect whose faulty design contributes to the collapse of a building – all these are examples of professionals who might be found guilty of malpractice.
A professional is expected to exhibit a standard of care which is considered reasonable for someone with their level of training and expertise. This is similar to the concept of negligence in much of personal injury law. However, because professionals are more highly trained than normal people, they can also be held accountable in ways that normal people cannot. A trained engineer, for example, would be expected to understand the laws of physics better than the average person.
